Information On Obtaining A Texas Marriage License

Note: These are general guidelines, specific questions should be directed to the county clerk's office of the county you are getting married in.

The process to get your marriage license is about the same throughout Texas. The Bride and Groom can obtain their marriage license from any County Courthouse/County Clerk's Office in the state of Texas.
When both parties are 18 years old or older the following procedure applies:
The Bride and Groom must go together to the County Clerk's office to obtain their marriage license.
In order to obtain a license the following are require:
I. One of the following forms of positive ID
1. Certified copy of Birth Certificate or
2. A valid passport or
3. A valid driver's license or
4. A valid military ID
II. Social Security number
III. $41.00 (cash only) for the license fee
No drug or medical records are required.
No blood tests or health certificates are needed.
Same sex marriage is not recognized in the State of Texas.
Special rules apply for those between 14 and 18 years of age, as well as for those who are divorced within the previous thirty days. Please contact the County Clerk's office for more information.
Note: in a few counties, an affidavit is required from each applicant stating they are not delinquent in any court-ordered child support payments. Please call the County Clerk's office to see if this applies and for instructions on this process.
The license is valid for 30 days from the date of issue. However, there is a 72 hour waiting period. When the license is purchased, it may not be used for the first 72 hours, unless
A. An applicant is a member of the armed forces of the United States, and is on active duty, or
B. An applicant obtains an order of a district court to waive the 72 hour waiting period
Give the license to the person who is officiating the ceremony, they will sign and complete the license and return it to the County Clerk's office. After it is recorded the original license will be returned to you and a copy will remain permanently on file in the county where it was purchased.
